Biographical/Historical note
During the Reconstruction era, former Confederate leaders were often charged with treason. According to the indictment, Samuel McMahandid "enlist in the army of the so-called Confederate States of America…and carrying on the said and open public war, insurrection and rebellion so traitorously commenced." And although the sheriff of Sevier County, Tennessee received the 13 summons, requesting that Samuel McMahan be brought before the Judge of the Circuit Court, on the back of each is a note stating that a search was made and the defendant was not found in that county.
